By creating an account, starting a trial, purchasing a subscription, or using DynaCarto, you agree to these Terms.

2. The Service

DynaCarto is a mobile spatial intelligence and geospatial analytics application designed to help users transform location data into maps, spatial analyses, and actionable geographic insights.

Depending on feature availability, subscription status, usage limits, and supported platforms, DynaCarto may include:

• AI-powered analysis guidance

• Excel data import

• Address geocoding

• Location creation and management

• Cluster Analysis

• Location Allocation

• Proximity & Coverage Analysis

• Suitability Analysis

• Isochrone Analysis

• Nearby Places / POI Search

• Hotspot Analysis

• Heatmap Analysis

• Data Mountains

• Anomaly Analysis

• Multiple map styles and visualizations

• Interactive map sharing

• Excel export

• GeoJSON export

• PDF export

• Other spatial analysis, visualization, mapping, and decision-support tools

DynaCarto is primarily provided as a mobile application.

We may update, improve, modify, add, remove, suspend, restrict, or discontinue any feature or part of the service where reasonably necessary.

3. Eligibility

You must have the legal capacity to enter into a binding agreement under the laws applicable to you in order to use DynaCarto.

If you use DynaCarto on behalf of a company, organization, or other legal entity, you represent that you have authority to bind that entity to these Terms.

4. Accounts

Certain DynaCarto features may require an account.

You are responsible for:

• Maintaining the confidentiality of your account credentials

• All activity occurring through your account

• Providing accurate and current account information

• Protecting your login credentials from unauthorized access

• Keeping your contact and subscription information up to date where applicable

You must notify us if you become aware of unauthorized access to your account.

We may suspend, restrict, or terminate accounts that violate these Terms, misuse the service, create security risks, or are used fraudulently.

5. Acceptable Use

You agree not to:

• Use DynaCarto for unlawful purposes

• Upload or process information that you are not legally authorized to use

• Upload malicious, fraudulent, harmful, infringing, or misleading content

• Attempt unauthorized access to DynaCarto or related systems

• Circumvent account, subscription, credit, usage, or security controls

• Interfere with the security, integrity, operation, or availability of the service

• Introduce viruses, malicious code, automated attacks, or other harmful technology

• Reverse engineer, decompile, disassemble, or attempt to derive source code except where applicable law expressly permits it

• Scrape or systematically extract DynaCarto content or data without authorization

• Copy, resell, sublicense, redistribute, or commercially exploit DynaCarto except as expressly permitted

• Use the service in a manner that creates unreasonable technical load or security risk

• Use DynaCarto to violate the privacy, intellectual property, contractual, or other rights of third parties

6. User Data and Responsibility

You remain responsible for information you upload, import, submit, analyze, share, or export through DynaCarto.

This may include:

• Excel files

• Addresses

• Geographic coordinates

• Place names

• Location identifiers

• Categories

• Numeric values

• Demand data

• Facility information

• Capacity information

• Business-related geographic information

• User-defined attributes

• Analysis parameters

• Map content

• Shared analysis results

You represent and warrant that you have the lawful right, authority, and permission to use and process such information through DynaCarto.

Where your data contains personal information relating to other individuals, you are responsible for ensuring that your processing complies with applicable privacy and data protection laws.

7. Spatial Analyses and User Decisions

DynaCarto provides analytical and decision-support tools.

Spatial analysis results may depend on:

• The quality and completeness of user data

• Geographic coordinates

• Geocoding accuracy

• User-selected parameters

• Travel mode

• Distance or travel-time assumptions

• Third-party mapping and location data

• Statistical methods

• External APIs

• Technical limitations

• Data availability

DynaCarto analysis results are intended to support decision-making and should not be treated as guaranteed outcomes.

Users remain responsible for reviewing and validating analysis results before relying on them for operational, commercial, financial, planning, healthcare, public-sector, infrastructure, property, or other decisions.

8. Credits, Usage Limits, and Plans

DynaCarto may use credits, quotas, subscription entitlements, feature limits, or other usage controls.

Where applicable, a credit may represent the processing of an address, location, geocoding request, analysis operation, or another unit of service as described in the application or official pricing information.

Available credits, limits, analysis capabilities, import sizes, and other entitlements may vary depending on:

• Subscription plan

• Trial status

• Promotional access

• Feature

• Platform

• Technical requirements

• Geographic availability

Certain example datasets, templates, demo data, or promotional datasets may not consume credits where expressly stated.

Unused credits, limits, or entitlements do not have monetary value unless expressly stated otherwise.

We may modify credit definitions, usage limits, plan structures, or feature availability where reasonably necessary. Material changes will be reflected in the application, pricing information, app store listing, or other official service channel as appropriate.

9. Subscriptions and Billing

Some DynaCarto features may require a paid subscription.

Subscriptions may be offered through:

• Apple App Store

• Google Play

• RevenueCat-supported subscription infrastructure

• Other supported billing channels

The price displayed by the applicable app store or payment platform at the time of purchase controls the amount charged.

Prices may vary by:

• Country

• Currency

• Taxes

• App store pricing

• Platform

• Local pricing policies

DynaCarto does not directly store full payment card numbers.

Payment processing is generally handled by the applicable app store or payment provider.

10. Renewals and Cancellations

Subscriptions may automatically renew unless cancelled according to the rules of the platform through which the subscription was purchased.

Users are responsible for managing subscription cancellation through the applicable store or platform.

For example:

Google Play:
Google Play Store → Payments & subscriptions → Subscriptions → DynaCarto

Apple App Store:
Settings → Apple Account → Subscriptions → DynaCarto

Exact menu names may vary depending on platform or operating system version.

Deleting a DynaCarto account does not automatically cancel an active Apple App Store or Google Play subscription.

Refunds, subscription renewals, store-level cancellations, and billing disputes are generally subject to the policies of the relevant app store or payment provider.

11. Free Trials and Promotional Access

DynaCarto may offer free trials, promotional credits, promotional access, or temporary feature entitlements.

Where offered, the current trial period and applicable conditions will be shown in the application, official website, or relevant app store.

Trial availability may depend on:

• User eligibility

• Previous trial usage

• Platform policies

• Geographic location

• Promotional campaign

• Subscription status

A trial may automatically convert into a paid subscription where clearly disclosed during the purchase or subscription process and permitted by the applicable app store.

Users should review the terms displayed by Apple App Store or Google Play before confirming a subscription.

12. AI-Powered Features

DynaCarto may include artificial intelligence features designed to help users select an appropriate analysis, interpret user objectives, or receive recommendations.

AI-generated recommendations:

• Are provided for informational and assistance purposes

• May not always be accurate or complete

• Should be reviewed by the user

• Do not replace professional judgment

• Do not guarantee a particular analytical or business outcome

Users should avoid entering confidential, highly sensitive, or unnecessary personal information into AI guidance fields.

13. Geocoding, Mapping, and Third-Party Services

DynaCarto may rely on third-party platforms, APIs, SDKs, and service providers for features such as:

• Geocoding

• Maps

• Travel-time calculations

• Distance calculations

• Isochrones

• Nearby Places / POI Search

• Spatial data

• Artificial intelligence

• Cloud infrastructure

• Hosting

• Databases

• Storage

• Authentication

• Analytics

• Diagnostics

• Subscription management

• Payment processing

• Notifications

• Customer support

These third-party services may be subject to their own terms, privacy policies, availability, usage limits, and technical restrictions.

We do not control and cannot guarantee the availability, completeness, accuracy, or continued operation of third-party services.

14. Shared Maps and Exports

DynaCarto may allow users to share analysis results through interactive map links or export information to supported formats such as Excel, GeoJSON, or PDF.

You are responsible for reviewing information before sharing or exporting it.

You should not publicly share information that:

• Contains confidential information

• Contains personal data you are not authorized to disclose

• Violates privacy laws

• Violates intellectual property rights

• Contains commercially sensitive information without appropriate authorization

Shared links may be subject to availability, expiration, access restrictions, or technical limitations.

15. No Guarantee of Results

DynaCarto is an analytical and decision-support tool.

We do not guarantee that:

• Geocoding results will always identify the correct location

• Spatial analyses will always produce the expected result

• Third-party map or POI information will always be complete or current

• Travel-time or distance calculations will exactly match real-world conditions

• Statistical analysis will be suitable for every dataset

• AI recommendations will always select the optimal analysis

• Analysis results will produce commercial, financial, operational, or strategic benefits

You remain responsible for evaluating the suitability and accuracy of DynaCarto outputs before making decisions.

16. Availability

We do not guarantee that DynaCarto will be uninterrupted, continuously available, error-free, or free from technical limitations.

The service may become temporarily unavailable due to:

• Maintenance

• Software updates

• Infrastructure problems

• Cloud provider outages

• Third-party API failures

• Network conditions

• Security incidents

• App store restrictions

• Force majeure events

• Other causes beyond our reasonable control

17. Intellectual Property

DynaCarto, including its:

• Software

• Application design

• User interface

• Algorithms

• Analysis workflows

• Branding

• Logos

• Text

• Graphics

• Reports

• Visual elements

• Documentation

• Website content

is owned by or licensed to Rutin Route Optimization & Software Solutions Ltd. Co. and is protected by applicable intellectual property laws.

Except where expressly permitted, you may not:

• Copy

• Modify

• Distribute

• Reproduce

• Create derivative works

• License

• Sell

• Transfer

• Republish

• Commercially exploit

any part of DynaCarto without prior authorization.

You retain ownership of data you lawfully upload to DynaCarto.

You grant us only the limited rights reasonably necessary to process that data for providing and operating the service.

18. Suspension and Termination

We may suspend, restrict, or terminate access to DynaCarto where reasonably necessary if:

• You violate these Terms

• You misuse the service

• You attempt to bypass usage or subscription limits

• Required subscription fees are not paid

• Fraudulent or abusive activity is detected

• Continued access creates a legal, technical, operational, or security risk

• We are required to do so by law, court order, regulator, app store, or platform rule

You may stop using DynaCarto at any time.

You may also request account deletion in accordance with our Account Deletion Policy.

19. Disclaimer

To the maximum extent permitted by applicable law, DynaCarto is provided on an "as is" and "as available" basis.

We disclaim, to the maximum extent legally permitted, all express or implied warranties, including warranties relating to:

• Merchantability

• Fitness for a particular purpose

• Accuracy

• Reliability

• Availability

• Non-infringement

• Completeness

• Compatibility

Nothing in these Terms limits statutory rights that cannot lawfully be excluded.

20. Limitation of Liability

To the maximum extent permitted by applicable law, Rutin Route Optimization & Software Solutions Ltd. Co. shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to DynaCarto.

This includes, where legally permitted, loss of:

• Profits

• Revenue

• Business

• Opportunities

• Data

• Goodwill

• Anticipated savings

• Operational efficiency

We are not responsible for decisions made solely in reliance on spatial analysis, AI recommendations, geocoding, mapping data, POI data, statistical outputs, or other DynaCarto results.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

21. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Rutin Route Optimization & Software Solutions Ltd. Co. from claims, liabilities, damages, losses, and reasonable costs arising from:

• Your misuse of DynaCarto

• Data you upload or process

• Content you share or export

• Your breach of these Terms

• Your violation of applicable law

• Your violation of third-party rights

22. Privacy

Your use of DynaCarto is also governed by the DynaCarto Privacy Policy.

The Privacy Policy explains how information may be collected, processed, stored, shared, and protected.

23. Account Deletion

Users may request deletion of their DynaCarto account and associated personal data in accordance with the DynaCarto Account Deletion Request process.

Account deletion does not automatically cancel an active App Store or Google Play subscription.

24. Changes to These Terms

We may update these Terms from time to time.

Changes may be made to reflect:

• New functionality

• Changes to DynaCarto

• Technical developments

• Changes in subscription structure

• Legal requirements

• Platform requirements

• Security requirements

The updated Terms will become effective when published through the DynaCarto application, DynaCarto website, app store listing, or another official service channel.

Where required by applicable law, material changes may be communicated separately.

Continued use of DynaCarto after revised Terms become effective constitutes acceptance of those Terms where permitted by law.

25. Governing Law

To the extent permitted by applicable law, these Terms are governed by the laws of the Republic of Turkiye, without regard to conflict-of-law principles.

Nothing in this section limits mandatory consumer rights or jurisdictional protections available under applicable law.

26. Governing Language

These Terms may be provided in multiple languages.

Where permitted by applicable law, the English version will prevail in the event of inconsistency between translations.

27. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue in full force to the maximum extent permitted by law.
