Dynacarto Terms of Service

Effective Date: September 1, 2026

These Terms of Service ("Terms") govern your access to and use of Dynacarto, operated by Rutin Route Optimization & Software Solutions Ltd. Co.

By creating an account, starting a trial, purchasing a subscription, accessing Dynacarto, or otherwise using the service, you agree to these Terms.

If you do not agree to these Terms, you must not use Dynacarto.

2. The Service

Dynacarto is a map-based planning, visualization, and geographic data management software service.

Depending on the platform, subscription plan, device capabilities, and feature availability, Dynacarto may include functionality such as:

• Creating and managing map-based projects

• Adding, editing, and removing geographic locations

• Working with addresses and geographic coordinates

• Geocoding addresses

• Displaying locations and geographic information on maps

• Creating map markers, labels, categories, tags, notes, and other project elements

• Organizing geographic information

• Importing supported files and structured geographic data

• Processing supported location and coordinate data

• Searching for or selecting locations

• Using device location with the user's permission

• Creating customized map views

• Generating map-related outputs

• Exporting supported project or geographic data

• Saving project settings and preferences

• Synchronizing supported data where applicable

• Related mapping, geographic visualization, project management, and data processing tools

The availability of specific features may vary between devices, operating systems, regions, subscription plans, application versions, and technical environments.

We may update, improve, modify, replace, restrict, suspend, or discontinue any part of Dynacarto from time to time.

3. Eligibility

You must have the legal capacity to enter into a binding agreement under the laws applicable to you in order to use Dynacarto.

If you use Dynacarto on behalf of a company, organization, or other legal entity, you represent that you have authority to bind that entity to these Terms.

4. Accounts

Certain Dynacarto features may require an account.

You are responsible for:

• Maintaining the confidentiality and security of your account credentials

• All activity occurring through your account

• Providing accurate and current account information

• Keeping your contact and billing information up to date where applicable

• Taking reasonable steps to prevent unauthorized use of your account

You must notify us if you become aware of unauthorized access to or use of your account.

We may suspend, restrict, or terminate accounts that violate these Terms, create security risks, or misuse the service.

5. Acceptable Use

You agree not to:

• Use Dynacarto for unlawful, fraudulent, abusive, or deceptive purposes

• Upload, submit, import, or process content that you do not have the legal right to use

• Upload harmful, malicious, infringing, defamatory, or intentionally misleading content

• Use Dynacarto to violate the privacy, intellectual property, contractual, or other rights of third parties

• Attempt to gain unauthorized access to Dynacarto, user accounts, servers, infrastructure, APIs, databases, or related systems

• Circumvent authentication, security measures, subscription controls, usage limits, or technical restrictions

• Introduce malware, malicious code, automated attacks, or other harmful technology

• Interfere with the security, availability, performance, or integrity of Dynacarto

• Use automated scraping, crawling, extraction, or similar techniques except where expressly authorized by us

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of Dynacarto except where such restriction is prohibited by applicable law

• Copy, reproduce, resell, sublicense, redistribute, or commercially exploit Dynacarto except as expressly permitted

• Use Dynacarto in a manner that imposes unreasonable technical load on our systems or third-party providers

• Use the service in a way that creates material legal, operational, security, or technical risks for us, our providers, or other users

We may take reasonable measures to prevent or investigate suspected abuse or misuse.

6. User Data and User Content

You remain responsible for information, files, content, and data that you create, enter, upload, import, submit, store, or process through Dynacarto.

This may include:

• Addresses

• Coordinates

• Geographic locations

• Map markers

• Place names

• Project names

• Labels

• Notes

• Tags and categories

• Imported files

• Images or documents

• Geographic datasets

• Project information

• Custom map information

• Other user-provided content

You represent and warrant that you have the lawful right, authority, permission, consent, or other appropriate legal basis to use and submit such information through Dynacarto.

You are responsible for determining whether information you upload or process contains personal, confidential, restricted, proprietary, or otherwise sensitive information.

7. Third-Party Personal Data

Dynacarto may allow users to enter or import information relating to other individuals, businesses, properties, or locations.

You are solely responsible for ensuring that your collection, use, upload, processing, sharing, and storage of such information complies with applicable law and any contractual obligations that apply to you.

You should not use Dynacarto to collect or process personal information that you are not legally permitted to use.

8. License to Process User Content

You retain ownership of your user-created content and data to the extent that you own such content.

You grant Rutin Route Optimization & Software Solutions Ltd. Co. a limited, non-exclusive license to host, store, reproduce, process, transmit, display, convert, and otherwise use your content solely as reasonably necessary to:

• Operate Dynacarto

• Provide features requested by you

• Store and synchronize your projects where applicable

• Process geographic and mapping operations

• Generate requested outputs

• Maintain, secure, troubleshoot, and support the service

• Comply with applicable legal obligations

This license exists only to the extent reasonably necessary to provide and operate Dynacarto and does not transfer ownership of your content to us.

9. Accuracy of User Data

You are responsible for verifying the accuracy, completeness, legality, and suitability of information you enter into or obtain through Dynacarto.

We are not responsible for errors caused by inaccurate, incomplete, outdated, incorrectly formatted, or misleading information supplied by users or third parties.

10. Subscriptions and Plan Limits

Dynacarto may offer free functionality, paid subscriptions, premium features, trials, promotional access, or other service plans.

Features, entitlements, storage allowances, usage limits, project limits, import or export limits, geographic processing limits, and other restrictions may vary by plan.

Current plan information may be displayed:

• Within Dynacarto

• On an official Dynacarto or Rutin Route website

• On an applicable App Store or Google Play listing

• During the purchase or subscription process

We may modify plan names, pricing, features, entitlements, usage models, or limits from time to time.

Changes to existing paid subscriptions will be handled in accordance with applicable law and the rules of the relevant billing platform.

11. Billing, Renewals, and Cancellations

Certain features of Dynacarto may require a paid subscription or purchase.

Subscriptions purchased through services such as the Apple App Store, Google Play, RevenueCat-supported billing systems, or other supported payment providers are subject to the applicable provider's billing, renewal, cancellation, refund, and payment rules.

Subscriptions may automatically renew unless cancelled in accordance with the applicable billing provider's procedures.

You are responsible for managing subscriptions purchased through third-party app stores through the account associated with the relevant platform.

Where permitted by applicable law, failure to pay applicable fees may result in paid features being suspended, restricted, downgraded, or terminated.

12. Trials and Promotional Access

Dynacarto may offer:

• Free trials

• Promotional subscriptions

• Temporary premium access

• Introductory pricing

• Discounted plans

• Limited-time features

• Promotional usage allowances

Such access may be limited by duration, account, device, region, campaign, eligibility, usage amount, subscription history, or other conditions.

Unless prohibited by applicable law, promotional programs may be modified or discontinued.

13. Third-Party Services

Dynacarto may depend on third-party platforms, services, APIs, SDKs, infrastructure, or software.

These may include providers of:

• Digital maps

• Map tiles

• Geographic information

• Geocoding

• Place search

• Location services

• Cloud hosting

• Data storage

• Authentication

• Analytics

• Crash reporting and diagnostics

• Subscription management

• Payment processing

• Communications

• Notifications

• Other technical infrastructure

Certain Dynacarto features may require information such as an address, coordinate, search query, or geographic location to be transmitted to an appropriate third-party provider in order to perform the requested function.

Third-party services may be governed by their own terms, licenses, privacy policies, usage limits, and service restrictions.

To the maximum extent permitted by applicable law, we are not responsible for outages, delays, errors, inaccuracies, restrictions, changes, or failures caused by independent third-party services.

14. Map and Geographic Information Disclaimer

Dynacarto is a mapping, geographic visualization, and planning assistance tool.

Maps, geographic coordinates, addresses, boundaries, place information, search results, geocoding results, map imagery, map tiles, labels, and other geographic information may originate from users or third-party data providers.

Such information may be:

• Incomplete

• Inaccurate

• Outdated

• Misplaced

• Incorrectly geocoded

• Differently represented between providers

• Temporarily unavailable

Dynacarto does not guarantee that any address, coordinate, geographic feature, boundary, map result, geocoding output, or location information is complete or accurate.

You are responsible for verifying important geographic information before relying on it.

15. No Guarantee of Results

Dynacarto provides tools that assist users with organizing, displaying, processing, and understanding geographic information.

We do not guarantee that any map, project, import, export, geocoding result, location result, visualization, generated output, or geographic dataset will meet a particular purpose or produce a particular result.

You remain responsible for decisions made using Dynacarto.

Dynacarto should not be used as the sole source of information where inaccurate geographic information could create a risk to life, health, safety, property, legal rights, or critical infrastructure.

16. Device Location

Some Dynacarto features may use the location functionality of your device.

Location-based features may require permission through your device operating system.

You are responsible for enabling or disabling location permissions through your device settings.

Device location information may be inaccurate due to factors including:

• GPS availability

• Device hardware

• Indoor environments

• Network conditions

• Operating system limitations

• User permissions

• Third-party location services

We do not guarantee the accuracy or continuous availability of device location information.

17. Imports and Exports

Dynacarto may allow supported data or files to be imported into or exported from the application.

You are responsible for reviewing imported and exported information for accuracy and completeness.

Compatibility may vary depending on:

• File type

• File format

• Character encoding

• Data structure

• Coordinate format

• File size

• Application version

• Third-party software

• Device capabilities

We do not guarantee that all third-party files, formats, applications, or systems will be compatible with Dynacarto.

18. Availability

We do not guarantee that Dynacarto will be uninterrupted, continuously available, timely, secure, or error-free.

The service may become unavailable because of:

• Scheduled maintenance

• Emergency maintenance

• Software updates

• Technical failures

• Infrastructure issues

• Cloud service failures

• Internet or network failures

• Third-party service outages

• Security events

• Platform restrictions

• Force majeure events

• Circumstances outside our reasonable control

We may also temporarily restrict certain functionality when reasonably necessary to maintain service security, stability, or integrity.

19. Intellectual Property

Dynacarto and its underlying software, interface, design, branding, graphics, text, application structure, databases, algorithms, documentation, trademarks, logos, and other proprietary materials are owned by or licensed to Rutin Route Optimization & Software Solutions Ltd. Co. and are protected by applicable intellectual property laws.

These Terms provide you only with a limited right to use Dynacarto in accordance with these Terms.

Except where expressly permitted by us or required by applicable law, you may not:

• Copy

• Modify

• Reproduce

• Distribute

• Publish

• License

• Sell

• Rent

• Transfer

• Create derivative works from

• Commercially exploit

any protected part of Dynacarto.

Third-party maps, geographic datasets, libraries, software components, trademarks, and other materials may remain the property of their respective owners and may be subject to separate license terms.

20. Feedback

If you voluntarily provide suggestions, ideas, comments, feature requests, or other feedback concerning Dynacarto, you grant us the right to use that feedback for purposes such as improving, developing, operating, and promoting Dynacarto without an obligation to compensate you.

This does not transfer ownership of your private project content or user data.

21. Suspension and Termination

We may suspend, restrict, or terminate your access to Dynacarto where reasonably necessary, including if:

• You materially violate these Terms

• You misuse the service

• You engage in fraudulent or unlawful activity

• Required fees are not paid

• Your account creates a material security or technical risk

• Continued access creates legal or regulatory risk

• We are required to take action by law, court order, regulator, app store, or other competent authority

• Dynacarto or a relevant part of the service is discontinued

Where reasonably practicable and legally permitted, we may provide notice before termination.

You may stop using Dynacarto at any time.

Deleting the application does not necessarily cancel an active subscription purchased through an app store. Subscriptions must be cancelled through the applicable billing provider where required.

22. Disclaimer of Warranties

To the maximum extent permitted by applicable law, Dynacarto is provided on an "as is" and "as available" basis.

We disclaim, to the fullest extent permitted by law, express, implied, statutory, and other warranties, including warranties relating to:

• Merchantability

• Fitness for a particular purpose

• Accuracy

• Availability

• Reliability

• Compatibility

• Non-infringement

• Data completeness

• Geographic accuracy

We do not warrant that Dynacarto will meet every user's requirements or that every error will be corrected.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

23. Limitation of Liability

To the maximum extent permitted by applicable law, Rutin Route Optimization & Software Solutions Ltd. Co. shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to Dynacarto.

This includes, where permitted by law, losses relating to:

• Profits

• Revenue

• Business opportunities

• Goodwill

• Anticipated savings

• Data

• Projects

• Geographic information

• Business interruption

• Third-party service failures

We are not responsible for losses resulting from a user's reliance on incorrect, incomplete, outdated, or inaccurate geographic information where such information originated from the user or an independent third-party data provider.

Nothing in these Terms limits or excludes liability where such limitation or exclusion is prohibited by applicable law.

24. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Rutin Route Optimization & Software Solutions Ltd. Co. from claims, liabilities, damages, losses, and reasonable costs arising from:

• Your unlawful or unauthorized use of Dynacarto

• Content or data submitted or processed by you

• Your infringement of third-party rights

• Your breach of these Terms

• Your violation of applicable law

This section does not apply to the extent such indemnification is prohibited by mandatory consumer protection law.

25. Privacy

Your use of Dynacarto is also subject to our Privacy Policy.

The Privacy Policy explains how personal data may be collected, processed, stored, disclosed, and protected when Dynacarto is used.

26. Changes to Dynacarto

We may develop, modify, update, replace, add, or remove features as Dynacarto evolves.

An application update may be required to continue using certain functionality.

We do not guarantee that any particular feature will remain available indefinitely.

27. Changes to These Terms

We may update these Terms from time to time to reflect changes in:

• Dynacarto

• Subscription models

• Technology

• Third-party services

• Business operations

• Security practices

• Legal or regulatory requirements

When these Terms are updated, we may revise the Effective Date displayed at the top.

The revised Terms become effective when posted in Dynacarto, on an associated official website, or through another official service channel, subject to any notice requirements imposed by applicable law.

Where required by applicable law, we may request renewed consent to materially revised Terms.

Continued use of Dynacarto after revised Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.

28. Governing Language

These Terms may be made available in multiple languages.

Unless applicable law requires otherwise, the English version will be used to resolve inconsistencies or interpretation differences between translated versions.

29. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue to apply to the maximum extent permitted by law.

The invalid or unenforceable provision will be interpreted or modified only to the extent necessary to make it enforceable where permitted by applicable law.

30. No Waiver

Failure by Rutin Route Optimization & Software Solutions Ltd. Co. to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.

31. Entire Agreement

These Terms, together with the Dynacarto Privacy Policy and any additional terms expressly applicable to a particular subscription, promotion, or feature, constitute the agreement between you and Rutin Route Optimization & Software Solutions Ltd. Co. regarding your use of Dynacarto.

Mandatory rights provided by applicable consumer law are not affected.
